Terms of Service

Welcome to ysTALENT. These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “you”, “your”) and ysTALENT (“ysTALENT”, “we”, “us”, “our”) governing your access to and use of the ysTALENT website, web applications, broadcast software, video player, and related match management and streaming services (collectively, the “Platform”).

By creating an account, browsing live matches, accessing streams, or registering a club workspace, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you do not agree with any part of these Terms, you must not use or access the Platform.

If you are registering an account or entering into this Agreement on behalf of a football club, academy, league, or organization, you warrant and represent that you have full legal authority to bind that entity to these Terms.

To access certain features of the Platform—including broadcasting matches, managing rosters, following clubs, or viewing subscriber-exclusive streams—you must register an account. We offer several user roles with specific privileges and obligations:

• Fan Accounts: Individuals who follow clubs, watch live matches, access replay archives, and interact with club content.
• Club Owners & Staff: Authorized representatives of football clubs who manage club profiles, schedule fixtures, configure broadcast sources (mobile cameras, IP cameras, encoders), invite team personnel, and operate the Live Control Room.
• Pitch-Side Camera Operators: Authorized individuals who access the Mobile Broadcaster interface to stream live match feeds directly to the Control Room via WebRTC/WHIP.
• Scouts & Analysts: Verified talent evaluators accessing advanced player metrics and match footage.

Football clubs and broadcast operators streaming on ysTALENT play a crucial role in grassroots sports. When a club publishes a match stream or recording to ysTALENT, the club represents and covenants the following:

• Broadcast Permissions: The club possesses all required rights, sanctions, and permissions from the governing football association, league, tournament organizer, and venue owner to broadcast the fixture.
• Player & Participant Likeness: The club has secured necessary player, referee, and coaching staff consents to capture, stream, record, and display their athletic performance and likeness on the Platform.
• Youth Safeguarding & Minors: For matches involving youth players (under 18 years of age), the club certifies that it complies with national safeguarding laws and football association child protection guidelines, including securing parental/guardian consent where required by applicable law.
• Safe Framing & Audio Conduct: Operators must frame pitch action appropriately and ensure pitch-side audio does not broadcast abusive, offensive, defamatory, or unlawful language.

Clubs retain all intellectual property ownership in their original match footage, team crests, and branding. By broadcasting or uploading content to ysTALENT, clubs grant ysTALENT a worldwide, non-exclusive, royalty-free license to host, transcode, stream, distribute, store, generate AI highlights from, and display such content to authorized fans and subscribers as necessary to deliver the Platform features.

Fans receive a limited, personal, revocable, non-exclusive, non-transferable license to view live streams and recordings made available to their tier. Match recordings and live streams may not be downloaded, screen-recorded, re-streamed, publicly broadcasted in commercial venues, or redistributed without express prior written consent from ysTALENT and the participating club.

ysTALENT offers free and paid subscription plans (such as Free, Plus, and Pro tiers) granting access to live matches, full-match replays, and multi-club following.

• Billing Cycle: Paid subscriptions are billed in advance on a recurring monthly or annual basis via our secure payment processors (e.g. Stripe).
• Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via your Account Settings.
• Free Trials & Promotions: If you register for a trial, access is granted for the promotional duration. Unless cancelled before the trial ends, your payment method will be charged the standard recurring plan rate.
• Refund Policy: Because digital streaming access is provided immediately upon subscription, fees are generally non-refundable for partial billing periods, except where required by mandatory consumer protection law.
• Price Changes: We reserve the right to modify subscription pricing with at least 30 days prior notice to existing subscribers.

Clubs partnering with ysTALENT receive access to broadcast tooling, automatic cloud recording archives, team workspaces, and AI-powered intelligence tools. Club partnership terms, 7-day trials, revenue-sharing models, and equipment integration agreements are governed by these Terms in conjunction with individual club partnership schedules agreed during club onboarding.

ysTALENT provides tools for clubs to monetize their matches through supporter subscriptions and digital tickets. Payouts are distributed to clubs according to the agreed payout schedule following deduction of applicable payment processing and platform service fees.

ysTALENT incorporates artificial intelligence and computer vision technologies, including AI Camera Tracking, Automated Commentary, Event Detection, and Match Intelligence Analytics (such as xG, possession, and pressing metrics).

You acknowledge that AI-generated commentary and analytical outputs are generated algorithmically for entertainment, coaching assistance, and informational purposes. ysTALENT does not guarantee 100% accuracy of statistical data or commentary interpretation and is not liable for coaching, scouting, or commercial decisions made based upon AI metrics.

You agree to use ysTALENT solely for lawful, authorized sports viewing and club management purposes. You agree NOT to:

• Capture, rip, screen-record, restream, re-transmit, or resell live broadcasts or video archive files without authorization.
• Use automated scripts, bots, scrapers, or crawlers to harvest match data, roster information, or video streams from the Platform.
• Circumvent, bypass, decrypt, or tamper with digital rights management (DRM), paywalls, geoblocking, or stream authentication protocols.
• Interfere with or disrupt the integrity or performance of streaming servers, MediaMTX WebRTC nodes, or network infrastructure.
• Upload or transmit content that is defamatory, obscene, harassing, hateful, or infringing upon third-party intellectual property rights.
• Share account credentials or allow unauthorized third parties to access subscriber-exclusive match feeds.

ysTALENT employs ultra-low latency WebRTC and WHEP streaming protocols designed to deliver pitch-side video with sub-second delay. However, live sports broadcasting inherently depends on factors outside our direct control, including pitch-side mobile 4G/5G signal strength, venue Wi-Fi stability, local internet service providers, camera hardware, and user device capabilities.

THE PLATFORM AND ALL MATCH STREAMS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YSTALENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND UNINTERRUPTED STREAM CONTINUITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YSTALENT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, GOODWILL, OR BUSINESS INTERRUPTION—ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

YSTALENT’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO YSTALENT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100.00).

You agree to defend, indemnify, and hold harmless ysTALENT, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) any content, stream footage, or participant likeness you broadcast or upload; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; or (d) your violation of applicable sports governing body regulations.

You may terminate your account at any time via your account settings or by contacting our support team. Upon termination, your right to access subscription features will cease at the end of your current billing period.

ysTALENT reserves the right to suspend, restrict, or terminate your account immediately and without prior notice if you violate these Terms, engage in fraudulent activity, broadcast unauthorized or abusive content, or pose a security risk to the Platform or other users.

We may update these Terms periodically to reflect changes in our streaming features, legal requirements, or commercial offerings. Material revisions will be notified via prominent notice on the Platform or via email at least thirty (30) days before taking effect. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of England and Wales (or the applicable EU member state jurisdiction where ysTALENT operates), without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall first be submitted to informal dispute resolution by contacting our legal team. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in the governing jurisdiction.
